The rules implement statutory provisions enacted by Title VII of the Dodd-Frank Act. These rules establish a registration requirement that applies to foreign boards of trade (FBOT) that wish to provide their identified members or other participants located in the United States with direct access to their electronic trading and order matching systems. Information is used to ensure registered FBOTs continue to meet the requirements for registration and provide necessary information regarding their activities, performance, and status, to demonstrate that they meet the conditions required to be met in order to retain their registration.
There are no program changes. The Commission is updating its burden estimates based on an increase in the number of respondents and also by revising its estimates regarding the burden hours associated with the reporting of swap transactions to a swap data repository. The number of registered FBOTs has increased from 24 to 25, yielding an increase in the burden hours associated with the filing of quarterly and annual reports. Additionally, the Commission is updating its estimate of the required burden hours per response for reporting of swap transactions to a swaps data repository under Regulation 48.8(a)(9)(i). The Commission has decreased its estimate of the associated reporting burden from 8.32 hours per response to 0.5 hours per response. This updated estimate is based on the Commissionâs experience with reporting during the life of the collection and is more consistent with the Commissionâs estimates for the reporting of swap transactions to a swap data repository for other CFTC-registered exchanges, such as swaps execution facilities and designated contract markets. As a result of these updates, the Commissionâs estimate of the total annual aggregate burden for all respondents has decreased from 8,648 hours to 5,097 hours.
