NRC actions and NRC-regulated activities may affect Indian Tribes and their current or ancestral Tribal lands. On January 9, 2017, the NRC published a Tribal Policy Statement (82 FR 2402). In its Tribal Policy Statement, the NRC indicted that it recognizes the Federal Trust Relationship with Indian Tribes and will uphold its Trust Responsibility to Indian Tribes. In its policy statement, the NRC indicated that it recognizes and is committed to a government-to-government relationship with Indian Tribes. The NRC also indicated that it will engage in timely consultations with Indian Tribes. The NRC is requesting OMB approval of a plan for a generic collection of information. The need and practicality of the collection can be evaluated, but the details of the specific individual collections will not be known until a later time. The information collected will include voluntary requests for information that would allow the NRC to more effectively involve Indian Tribes in the NRCâs regulatory activities and to enable the NRC to plan the NRCâs Tribal outreach and consultation activities.
This is a request for a plan for a new generic collection of information. Under this plan, the NRC staff would send voluntary requests for information and comments to Indian Tribes. These requests would impose an estimated 4,800 hours of annual burden at a cost of $1,320,000 (4,800 hours x $275/hr) on Indian Tribal governments. Over the course of the 3-year clearance period, this will be 14,400 hours at a cost of $3,960,000. The information requested is the minimum necessary to provide Indian Tribes 1) the opportunity to review and provide comments on documents pertaining to the NRCâs regulatory actions with Tribal implications, 2) the opportunity to provide comments on other NRC activities that may affect Indian Tribes or would be of interest to Indian Tribes, and 3) other information that would allow the NRC to better understand the effects of its activities on Indian Tribes.
On behalf of this Federal agency, I certify that the collection of information encompassed by this request complies with 5 CFR 1320.9 and the related provisions of 5 CFR 1320.8(b)(3).
The following is a summary of the topics, regarding the proposed collection of information, that the certification covers:
(i) Why the information is being collected;
(ii) Use of information;
(iii) Burden estimate;
(iv) Nature of response (voluntary, required for a benefit, or mandatory);
(v) Nature and extent of confidentiality; and
(vi) Need to display currently valid OMB control number;
If you are unable to certify compliance with any of these provisions, identify the item by leaving the box unchecked and explain the reason in the Supporting Statement.
