Terms of Clearance: BIA should continue to work with prospective applicants that are interested in Tribal Energy Resource Agreements. Within one year, BIA must submit a report to OMB that identifies (1) the aspects of this collection that tribes have identified as having the greatest burden for them, (2) whether these burdensome aspects are required under statute or regulation, and (3) opportunities to reduce the burden of the application process, including providing greater clarity by issuing guidance or instructions for prospective applicants.

Abstract: This information collection allows the Department to implement law that authorizes the Secretary to enter into Tribal Energy Resource Agreements (TERAs) with Indian Tribes. See 25 U.S.C. 3504. TERAs promote tribal oversight and management of energy and mineral resource development on tribal lands and further the goal of Indian self-determination.
