The United States Patent and Trademark Office (USPTO) is submitting this request to update this information collection. The USPTO has determined that the response estimates used to calculate the hour and cost burdens in the 2011 renewal (approved by OMB on December 6, 2011) were based on the total number of classes filed instead of the total number of applications filed. Since the number of classes was used for the response estimates, the USPTO estimates that the response, burden hour, and cost estimates reported in the renewal were greater than the actual trademark submissions. The USPTO is therefore submitting this request to adjust the current inventory estimates for this collection.
This collection currently has 380,289 responses, 132,106 burden hours, and $117,791,578 in annual (non-hour) costs. The USPTO is updating the burden estimates for this collection because the response estimates used to calculate the hour and cost burdens in the 2011 renewal were based on the total number of classes filed instead of the total number of applications filed. The USPTO estimates that this change will reduce the response estimates by 83,542 responses per year. This in turn will reduce the burden hours by 29,022 hours and the annual (non-hour) costs by $26,435,591. These reductions are all due to administrative adjustments. Therefore, the USPTO estimates that this collection will have 296,747 responses, 103,084 burden hours, and $91,355,987 in annual (non-hour) costs.
