Employees may file complaints with the Agency for investigation alleging that their employer violated "whistleblower" protection provisions contained in certain statutes and regulations for which the Agency has investigatory responsibility. These whistleblower provisions prohibit retaliatory action by employers against employees who report alleged violations of certain laws or regulations or otherwise engage in protected activities specified by the whistleblower provisions.

The anticipated increase in burden hours occurred due to the recent enactment of Section 31307 of the Moving Ahead for Progress in the 21st Century Act (MAP-21), P.L. 112-141, codified at 49 U.S.C. 30171. OSHA estimates that it will conduct 4 investigations annually under the MAP-21 statute. The Agency anticipates promulgating a procedural regulation for investigations conducted under this statute at a later date. OSHA is therefore requesting a program increase of 4 burden hours.
