This is a justification for the Department of Labor, Employment and Training Administration's (ETA) request for a new collection describing reemployment activities for UI claimants in Federal programs to comply with PL 112-96, the Middle Class Tax Relief and Job Creation Act of 2012. The basic report format is designed to be very similar to the existing ETA 9002 report (OMB number 1205-0240) that covers quarterly performance data for the Wagner-Peyser Act funded public labor exchange. ETA has well established reporting instructions, reporting software, reporting formats and reporting logic that is used with existing reemployment service delivery reporting for UI claimants, and will be duplicating this structure to serve UI claimants in Federal programs, as required by PL 112-96.
Traditional clearance processes would result in public harm by limiting the options states have to address the persistent unemployment problem. Furthermore Public Law 112-96 mandates immediate implementation of this data collection.
On behalf of this Federal agency, I certify that the collection of information encompassed by this request complies with 5 CFR 1320.9 and the related provisions of 5 CFR 1320.8(b)(3).
The following is a summary of the topics, regarding the proposed collection of information, that the certification covers:
(i) Why the information is being collected;
(ii) Use of information;
(iii) Burden estimate;
(iv) Nature of response (voluntary, required for a benefit, or mandatory);
(v) Nature and extent of confidentiality; and
(vi) Need to display currently valid OMB control number;
If you are unable to certify compliance with any of these provisions, identify the item by leaving the box unchecked and explain the reason in the Supporting Statement.
