Terms of Clearance: Consistent with previous terms of clearance, OMB reminds the agency that this collection will not be approved for the 2012 reporting period unless the basic race and ethnicity categories comply with OMB’s 1997 Standards for Maintaining, Collecting, and Presenting Federal Data on Race and Ethnicity, and do not conflict with the Department of Education's collection of school staff race and ethnicity information. Based on conversations with EEOC, it is OMB’s understanding that EEOC is considering potential revisions to this report. OMB expects that any such revisions will be fully consistent with the Paperwork Reduction Act and Federal statistical standards. With the exception of making the basic race and ethnicity categories consitent with OMB standards, in order to minimize burdens and costs to respondents, OMB recommends that EEOC make any planned revisions to this report simultaneously, rather than in a piece-meal fashion. OMB also recommends that EEOC seek input from affected stakeholders about any revisions as early as possible, and provide respondents with ample notice before making revisions in order to minimize and ease burdens. Finally, OMB expects EEOC to keep it updated about any possible revisions to this report on a regular basis.

Abstract: EEOC regulations require Public Elementary and Secondary School districts with 100 or more employees to collect and retain in their records demographic information about their employees, and report this information to EEOC biennially in even-numbered years. EEOC uses this information to enforce civil rights laws and shares it Office for Civil Rights (OCR) of the Department of Education and the U. S. Department of Justice.
