10 CFR Part 150 provides certain exemptions from NRC regulations for persons in Agreement States. Part 150 also defines activities in Agreement States and in offshore waters over which NRC regulatory authority continues, including certain information collection requirements. The information is needed to permit NRC to make reports to other governments and the International Atomic Energy Agency in accordance with international agreements. The information is also used to carry out NRC's safeguards and inspection programs.
The overall burden has increased by 155 hours from 35 to 190 hours because of the addition of 5 new respondents that are now required to comply with the requirements of 150.31(b)(3)(C)(iii). This also increased the number of respondents from 10 to 15 respondents. 10 CFR 150.31(b)(3)(C)(iii) specifies the requirement for each licensing action which has a significant impact on human environment, to provide a written analysis in the form of an environmental assessment report, by the appropriate State agency (which shall be available to the public before the commencement of any such proceedings) of the impact of such licensing action. It is estimated that of the six respondents (1 currently reporting + 5 additional) that are now required to comply with 150.31(b)(3)(C)(iii), a total of two environmental assessment reports will be prepared annually with each report taking approximately 80 hours to prepare for Agreement State Licensees. This requirement will increase the burden by 160 hours. Therefore, the overall burden cost will increase by $42,030 hours, from $6,800 to $48,830.
Although there was a major burden increase, there was a minor burden reduction of 5 hours, which resulted in a decrease of 6 responses. In addition, the cost for professional staff increased from $197 to $257 per hour.
