Terms of Clearance: This ICR is approved. OMB encourages EPA to pay more careful attention to the preparation of ICR supporting statements. For example, this supporting statement makes mistaken reference to 'Capital and OMB Costs' rather than 'Capital and operation and maintenance (O & M) Costs' and then indicates 'OMB - no postage of [sic] filing costs.' OMB notes that aside from the erroneous focus on OMB costs, this ICR covers a reporting requirement for which EPA claims that none of the responses will be collected electronically. EPA should therefore have clarified how respondents will report without incurring postage costs. In addition, OMB notes that EPA provides no explanation for its estimate of the burden associated with this collection. EPA is reminded that 5 CFR 1320.8 requires the Agency to review each collection before submission to OMB for review, and that, per 1320.8(a)(4), that review shall include 'a specific, objectively supported estimate of burden . . . .' EPA is advised that future submissions that fail to meet the requirements of 5 CFR 1320.8 may be returned as improperly submitted.

Abstract: The EPA Office of Mobile Sources determines whether a vehicle is excluded from requirements under the Clean Air Act (Act) based on the criteria listed in 40 CFR 85.1701-Exclusion and Exemption of Motor Vehicles and Motor Vehicle Engines. A manufacturer who desires a determination by the EPA as to whether a particular type of vehicle is excluded from coverage under the Act must submit specifications describing the size, use, top speed, etc., of the vehicle so that the determination can be made.
