OMB understands that EPA now plans to split this burden reduction proposed rule into two final rules to be promulgated on differend schedules. EPA should prepare separate ICRs for each of the final rules which reflect only those reporting requirement changes included in each rule. OMB has reviewed the proposed rule and agrees that all of the proposed changes to the EPCRA 311 and 312 reporting requirements represent appropriate burden reductions which will not compromise the proper performance of the agency's function. OMB encourages EPA to promulgate both final rules as expeditiously as possible. OMB particularly supports EPAs plans to promulgate the releif to service stations in time for the 1999 reporting deadline.

Section 311 requires that the owner or operator of any facility which is required to prepare a report to have available material safety data sheets (MSDSs) for a hazardous chemical under OSHA regulations and shall submit an MSDS for each such chemical or a list of chemicals to the LEPC, SERC, and local fire department. This submittal allows both local emergency planners/responders and the community to have information regarding the hazards of chemicals used at the facility.
