The HCD Amendments Act of 1978, as amended by the HCD of 1987 and the McKinney Amendments of 1988, requires that HUD preserve the number of units which are occupied by low-moderate income persons at the time of assignment of foreclosure, whichever is greater. HUD must therefore inquire as to the income level of unassigned tenants for whom information is not available.
