ANNUAL STATUS REPORT AND CERTIFICTION AND WEEKLY INSPECTIONS OF REFUSE PILES AND IMPOUNDMENTS (30 CFR 77.215-2(B)(4) THROUGH (8) & (C), 77I.215.3, 77.216-3, & 77.216-4)
We have approved continued use of these recordkeeping requirements for two additional months in order to allow the agency additional time to consider scheduling a regulatory review of these provisions, as we directed in our conditions of clearance dated July 2, 1987. The agency has not yet addressed the concerns raised in our clearances of April 4, 1986 and September 4, 1986. In particular, it is not clea with regard to the requirement in 30 CFR 77.216-3 for weekly examinations of impoundments that certification, as defined in 5 CFR 1320.7(k)(1), could not fulfill the agency's mission while imposing less burden. In addition, it remains unclear why this information must be collected on a weekly basis for each impoundment.
