THE AGENCY HAS NOT YET ADDRESSED TWO OF THE CONCERNS RAISED IN OUR EARLIER CONDITIONS OF CLEARANCE DATED 9/19/84, AND REITERATED IN OUR CONDITIONS OF CLEARANCE DATED 11/21/84. FIRST, THE NEED AND PURPOSE OF THE RECORD FOR SAFETY DEFECT RECORDS ARE NOT CLEAR IN THIS SUBMISSION. OTHER APPROACHES, SUCH AS A CERTIFICATION, WOULD SEEM TO MEET THE AGENCY'S NEEDS AND WOULD IMPOSE A LESSER BURDEN ON THE PUBLIC SECOND, THE NEED AND PRACTICAL UTILITY OF INSPECTIONS OF EQUIPMENT ON EACH SHIFT IS NOT CLEAR. WE HAVE THEREFORE RETAINED THESE CONDITIONS OF CLEARANCE IN THIS APPROVAL THROUGH 3/87, BY WHICH TIME THE AGENCY WILL HAVE COMPLETED FINAL RULEMAKING. WITH THE SUBMISSION OF THE FINA RULE, WE WILL REVIEW THE AGENCY'S RESPONSE TO THESE CONCERNS AS PROVIDED IN 5 CFR 1320.13(E) AND (G).
