PRIOR TO BEGINNING THIS INFORMATION COLLECTION EDUCATION MUST PROVIDE OMB WITH A LEGAL OPINION SIGNED BY THE DEPARTMENT'S GENERAL COUNCIL ADDRESSING THE FOLLOWING: 1. THE SPECIFIC STATUTORY RESPONSIBILITIES FOR CONDUCTING THIS DATA COLLECTION AND WHAT LEGAL PROBLEMS, IF ANY, WOULD BE ASSOCIATED WITH ACCEPTING THIS DATA AS A GIFT. THE QUESTION OF WHETHER THESE STATUTOR RESPONSIBILITIES CAN BE FULFILLED IN A SITUATION WHERE A CONTRACTURAL RELATIONSHIP WITH THE COLLECTOR OF THE DATA DOES NOT EXIST SHOULD BE DISCUSSED IN THE OPINION. 2. ANY CONFLICTS WITH EXISTING PROCUREMENT REGULATIONS PERTAINING TO EDUCATION DEPARTMENT ACTIVITIES RESULTING FROM ACCEPTING THIS DATA AS A GIFT OR FOR A NOMINAL FEE ON A NON-COMPETITIVE BASIS. THE LEGAL OPINION MUST BE PROVIDED AT LEAST 2 WEEKS BEFORE BEGINNING THE DATA COLLECTION. AFTER REVIEWING THE LEGAL OPINION, OMB MAY RECONSIDER THE APPROVAL OF THE INFORMATION COLLECTION. OMB REPRESENTATIVES DISCUSSED THESE ISSUES WITH EDUCATION DEPARTMENT OFFICIALS ON 4-9-84 WITH REGARD TO AN OFFER MADE BY A PRIVATE SECTOR FIRM. THIS LEGAL OPINION IS NECESSARY TO CLARIFY THE DEPARTMENT'S POSITION AS TO WHY SUCH AN OFFER CANNOT BE ACCEPTED.
